APEX EQUESTRIAN BUILDINGS TERMS & CONDITIONSLast updated: October 2026
1. ABOUT USApex Equestrian Buildings is a trading name of Apex Contracting Group Ltd ("Apex", "we", "us" or "our").These Terms & Conditions apply to orders placed with Apex Equestrian Buildings, whether through our website, by telephone, email, quotation or other agreed means.By placing an order with us, you agree to these Terms & Conditions.Nothing in these Terms & Conditions affects your statutory rights.2. QUOTATIONS & ORDERSAll quotations are based on the specification, dimensions, options, delivery location and installation requirements provided at the time of quotation. An order is confirmed once we have accepted the order and received the required deposit.Any alterations requested after confirmation may affect the price and estimated manufacture, delivery or installation date.Where dimensions, layouts or specifications are supplied or approved by the customer, the customer is responsible for checking that they are correct before manufacture begins.Images, drawings and photographs are for illustrative purposes. As our buildings are manufactured from timber and may be individually made to order, reasonable variations in appearance can occur.3. PAYMENT TERMSA 50% deposit of the total order value is required to confirm the order and secure a place in our production schedule. The remaining balance must be paid in full no later than the day before the agreed delivery, collection or installation date. All goods must be paid for in full before they are delivered or collected, or before installation commences. We reserve the right to postpone delivery, collection or installation where cleared payment of the outstanding balance has not been received.Any alterations, additional work or extras agreed after the original order may be charged separately.4. MADE-TO-ORDER & BESPOKE BUILDINGSThe majority of Apex buildings are manufactured following receipt of an order rather than being supplied as finished stock products.Where a building is manufactured to a customer's individual specifications or is clearly personalised, statutory cancellation rights applicable to ordinary distance-sale goods may not apply.Individual specifications may include customer-specific dimensions, layouts, openings, partitions, doors, roofing arrangements or other alterations specifically agreed for that customer's building.Where an order does not legally qualify for this exemption, any applicable statutory cancellation rights will continue to apply.5. CANCELLATIONS & DEPOSITSOnce an applicable statutory cancellation period has expired, or where an order is exempt from statutory cancellation rights because it is made to the customer's specifications or clearly personalised, cancellation by the customer may result in Apex retaining some or all payments already made to cover reasonable losses caused by the cancellation. These losses may include timber and other materials purchased, ordered, allocated or cut for the customer's building; manufacturing and workshop labour already undertaken; design and preparation work; specially ordered components; administration costs; transport or installation commitments; and other reasonable losses directly resulting from the cancellation.Where our reasonable losses are less than the amount already paid, the appropriate balance will be refunded.Where our reasonable losses exceed the amount already paid, we reserve the right, where legally permitted, to recover the additional reasonable loss.We will take reasonable steps to minimise losses following a cancellation.Nothing in this section affects the customer's statutory rights.6. CHANGES TO AN ORDERChanges requested after an order has been confirmed are subject to our agreement.Once materials have been ordered, cut or manufacturing has commenced, some alterations may not be possible.Where changes are possible, additional materials, labour or manufacturing costs may be charged and the agreed delivery or installation date may change.7. DELIVERY & INSTALLATIONWhere included with the product purchased, delivery and professional installation are FREE within 50 miles of our base. For locations beyond 50 miles, delivery and installation is charged at £1.50 per additional mile, each way.For locations over 100 miles, please contact us for a tailored quotation.Any applicable delivery charge will be confirmed before the order is finalised.Delivery and installation dates are estimates unless expressly agreed otherwise.Circumstances outside our reasonable control, including severe weather, unsafe ground conditions, access problems, transport disruption or supplier delays, may occasionally require delivery or installation to be rearranged.8. CUSTOMER COLLECTIONWhere an order is arranged for collection, the customer is responsible for providing a suitable vehicle or trailer and ensuring that the building or components can be transported safely and legally. The order must be paid for in full no later than the day before collection.9. SITE ACCESSThe customer is responsible for ensuring there is safe and suitable access to the installation location for our vehicles, trailers, equipment and installation team. The customer must inform us beforehand of restricted access, narrow gateways, soft ground, overhead cables, trees, drainage, underground services, steep gradients or any other obstruction or hazard that may affect delivery or installation.Where we cannot safely deliver or install because of conditions that were not disclosed beforehand, additional transport, labour, equipment or return-visit costs may be charged.10. GROUND PREPARATION & BASEUnless specifically included within our quotation, ground preparation and the base are the customer's responsibility. The installation area must be level, firm, adequately drained and suitable for the size and type of building being installed. An unsuitable or unlevel base can cause a timber building to settle unevenly and may affect doors, partitions, roof lines and the structure.Apex cannot accept responsibility for problems caused by inadequate ground preparation, subsidence, ground movement or failure of foundations or groundworks not supplied or installed by Apex.11. PLANNING PERMISSION & OTHER CONSENTSIt is the customer's responsibility to establish whether planning permission, building regulations approval, landlord consent or any other permission is required for the building and its proposed location.Unless specifically agreed in writing, Apex does not obtain these permissions on the customer's behalf.12. TIMBER - NATURAL CHARACTERISTICSTimber is a natural material and reacts naturally to changes in temperature, moisture, humidity and weather conditions.Natural characteristics can include knots, shakes, surface splits, checking, grain variation, colour variation, resin, shrinkage, expansion, twisting, warping and movement. These natural characteristics do not automatically mean that timber or a building is defective.Doors, boards, cladding and other timber components can move as timber dries, acclimatises and responds to seasonal conditions.Nothing in this section affects statutory rights where goods are genuinely faulty, not as described or otherwise fail to meet applicable legal requirements.13. SETTLEMENT & DOOR ADJUSTMENTTimber buildings can naturally settle and move following installation.Stable doors and other heavy timber doors may move slightly as the building and timber acclimatise.Hinges, bolts, catches and other ironmongery may occasionally require adjustment following installation or as seasons change.Reasonable adjustment resulting from normal timber movement does not in itself indicate a structural or manufacturing defect.14. ROOFING, SKYLIGHTS & CONDENSATIONCondensation can naturally occur on metal roofing and translucent roof sheets or skylights because of differences in temperature and humidity.Where translucent sheets or skylights do not incorporate the same anti-condensation treatment as other roofing sheets, condensation may be more noticeable.Condensation caused by normal atmospheric or environmental conditions does not in itself indicate that a roof is defective or leaking.15. SEVERE WEATHER & BUILDING LOCATIONCustomers should consider the location and exposure of their building, particularly in areas exposed to high winds, storms, flooding or unusually severe weather.Buildings must be appropriately positioned and secured for their location and ground conditions.Apex is not responsible for damage caused by extreme weather, flooding, falling trees, ground movement or other external events outside our reasonable control where the building itself was not defective.16. SELF-BUILD / SUPPLY-ONLY BUILDINGSWhere a building is purchased on a self-build or supply-only basis, the customer is responsible for its correct assembly, installation, levelling, fixing, anchoring and securing unless otherwise agreed in writing.Apex cannot accept responsibility for defects or damage caused by incorrect assembly, incorrect fixing, modification, inadequate foundations, unsuitable ground conditions or failure to follow installation information supplied by us.This does not affect responsibility for components that were faulty or defective when supplied.17. TREATMENT & MAINTENANCETimber buildings require ongoing care and maintenance.Customers are responsible for periodically inspecting their building and undertaking appropriate maintenance, including re-treatment of external timber when required, checking roofing and fixings, maintaining doors and ironmongery, checking anchoring and structural fixings, and promptly repairing damage.Failure to undertake reasonable maintenance may affect a warranty claim where the lack of maintenance caused or materially contributed to the problem.18. WARRANTYUnless otherwise expressly stated in writing, Apex buildings are supplied with our standard 12-month warranty against defects attributable to our materials or workmanship.Where a qualifying Apex maintenance package has been purchased and its applicable conditions are complied with, an extended warranty of up to 5 years may apply where expressly confirmed as part of the customer's order.Warranty cover does not apply to normal timber characteristics or movement, ordinary wear and tear, lack of maintenance, accidental damage, misuse, animal damage, unauthorised alterations, incorrect self-build installation, unsuitable ground conditions or damage caused by external events outside our reasonable control. Our warranty is in addition to and does not replace or restrict statutory rights.19. INSPECTION & REPORTING PROBLEMSCustomers should inspect their building or components as soon as reasonably practicable following delivery, collection or installation. If damage, missing components or a workmanship concern is identified, please contact us promptly and provide photographs and details where reasonably possible.Prompt notification helps us investigate and resolve problems efficiently and does not remove or restrict statutory rights.20. ALTERATIONS, RELOCATION & THIRD-PARTY WORKApex cannot accept responsibility for problems caused by alterations, repairs, dismantling, relocation or other work undertaken by the customer or a third party after delivery or installation.Where a building is subsequently moved, the customer is responsible for ensuring it is correctly reinstalled, levelled, anchored and secured.21. HORSES & OTHER ANIMALSThe customer is responsible for routinely inspecting buildings used to house horses or other animals and ensuring they remain suitable and safe for continued use.Damage caused by animals, including kicking, biting, chewing, rubbing or impact, is not considered a manufacturing defect.Any damaged component that could create a risk to an animal or person should be repaired or replaced promptly.22. OUR RESPONSIBILITYApex will provide goods and installation services in accordance with the agreed contract and applicable law.Where we provide installation to a consumer, we will perform that service with reasonable care and skill.Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful.23. EVENTS OUTSIDE OUR REASONABLE CONTROLWe are not responsible for delay or failure to perform an obligation where this results from circumstances genuinely outside our reasonable control. These may include extreme weather, flooding, serious transport disruption, road closures, accidents, supplier disruption or other events that could not reasonably have been avoided.Where such circumstances affect delivery or installation, we will endeavour to rearrange the work as soon as reasonably practicable.24. WEBSITE INFORMATION, PRICES & ERRORSWe make every reasonable effort to ensure product descriptions, specifications, options and prices displayed on our website are accurate. If we discover an obvious pricing, specification or technical error after an order has been submitted, we will contact the customer as soon as reasonably possible to explain the error and available options.Product photographs are representative and should not be relied upon as showing the exact grain, colour, knot pattern or other natural characteristics of timber used for an individual building.25. COMPLAINTSIf you have a concern regarding a product, delivery or installation, please contact us as soon as possible so we have an opportunity to investigate and resolve the matter.Email: info@apexcgl.comTelephone: 07908 20137426. GOVERNING LAWThese Terms & Conditions are governed by the laws of England and Wales.Nothing in this provision deprives a consumer of any mandatory legal protections that apply to them.
